This Indenture made and entered into this 29th Nov A D one thousand eight hundred and seventy six between John Sharp and Mary sharp of the County of Anderson and State of Tennessee of the one part and Hesikeih Rutherford and his hires of the same place of the other part Witnesseth that the said John and Mary Sharp for and in consideration of the sum of 50.00 fifty dollars  to him in hand paid the receipt whereof is hereby acknowledged hath and by these presents doth grant bargain and sell and transfer unto the said Hesekoh Rutherford and his heirs and assigns forever a certain tract of land lying in Anderson County in the state of Tennessee District No 2 bound as follows towit  beginning on a Chestnut on the lot line on the southside of the riged thence north with lot line to a stake and le?t w?? John T. Rutherford, a resident of St. Marys County, Maryland in 1776, enlisted, September 9,  1778, in the 7th Maryland  Regiment for a term of three years.  He served as a Corporal in Captain Benjamin Spikerís  Company.  He moved to Tennessee in the late 1700ís, and purchased a tract of land from  James Wood, in 1798, on Flat Creek in Knox County.    John Rutherford named his wife and children in his will, dated December 17, 1817, and  probated in Knox County,  Tennessee in April 1818.

Notes for William Rutherford, Sr.:
listed in Montgomery Co.,VA from 1774-1786. His oldest son, William Jr was born June 10, 1748 and his youngest Finney 1773. Finney signed a letter for his brother Julius, I think, January 19, 1852, of Lee Co.,VA. The letter was done by Pierce S. Rutherford an acting Justice of the Peace. At that time Finney was 79 years of age. He said when Julius came home from the War that they lived in Wythe Co.,VA. That Julius went to N.C. (Tenn now) and when he came back he was married to Rhoda Rutherford, his cousin. They lived on William Rutherford Sr's land for several years, until they had 2 or 3 children. Julius then moved to KY, then Knox Co.,TN, then Anderson Co.,TN where Julius died. I believe what it says is that Julius went to KY Co which is now TN, but at that time it was NC. As William Rutherford Sr shows ten boys and no girls, there are probably some missing daughters.

Joseph Rutherford was designated as a 2nd Lieutenant, November 23, 1779 in Rockingham County, Virginia in Captain Reagan's Company, and he was administered the oath of allegiance, March 27, 1780.  Joseph Rutherford, and both his brothers Archibald and Elliot, were listed in the military vouchers of Captain Richard Reagen's Company No. 13, in 1788.

Notes for Joseph Rutherford, Sr.:
Joseph Rutherford was a resident of Essex County, Virginia in the 1720's and early 1730's as he appeared in Essex County court proceedings December 16, 1727 in Conjunction with John Rutherford, Jr., his brother, and August 17, 1730 with Thomas Rutherford, also his brother.

  County court record in Essex, Goochland, Cumberland, Augusta and Rockingham Counties, Virginia, attest to the fact that Joseph Rutherford bought and sold land and was active in those areas of Virginia for many years.  Joseph Rutherford was a witness to a conveyance of land in Spotsylvania County, Virginia, for John Miller of Caroline County, Virginia, February 1, 1729.  August 11, 1764, Joseph witnessed for John Miller in Augusta County.  Joseph Rutherford entered 260 acres of land on Willis River in Albemarle County, Virginia, and later conveyed one-half the original patent to John Rutherford, his brother, November 25, 1751.  The suit of Joseph Rutherford's son Elliot, to clear the title of the other one-half of the patent, is recorded in the District Court of Prince Edward County, Virginia.  Mary Rutherford, his sister, widow of Colonel James Wood, conveyed a tract of 400 acres of land on Cub Creek in Augusta County, Virginia, to Joseph Rutherford, December 31, 1760.  May 16, 1768, Joseph Rutherford divided this tract of land equally among three of his sons, Joseph, Jr., Reuben and Thomas.  Joseph Rutherford entered an importation right on Hill Meadow Spring, and obtained the land from Elinor Mountyjoy, July 16, 1753.

   Joseph Rutherford died testate.  He devised his estate to his wife Mary, and to his living sons Elliot, Joseph, Reuben, Robert and Archiblad.  He appointed Elliot Rutherford as his sole executor.  The will of Joseph Rutherford, dated June 7, 1787, was proved April 28, 1788 in Rockingham County, Virginia.

Robert Rutherford, Jr., served as a witness for his father in the August term of court in 1724 in Essex County, Virginia.  The court order specified that Robert Rutherford pay Robert Rutherford, Jr., for serving two days as a witness.

   Robert Rutherford, Jr., died intestate in Essex County, Virginia, March 15, 1725, his son John Rutherford, Jr. relinquished his right to the administration of the estate and a certificate was granted to John Rutherford, his uncle, with John Vawter and Thomas Thorpe as his securities, gave bond for the just and faithful administration of the estate.  The inventory was dated April 18, 1726 and the appraisement of the estate was returned June 21, 1726 by John Rutherford, administrator.

Immigrant Ancestor
He was probably one and the same as the Robert Rutherford who was baptized May 6, 1640, a son of Adam Rutherford of Hall and Janet Rutherford of Roxburgh County, Scotland.

  The name Robert Rutherford was recorded as early as March 10, 1676 in Old Rappahannock County, Virginia, and as late as August 21, 1728 in Essex County, Virginia.  Conveyances of land by Robert Rutherford and his wife Margaret verify their places of residence were in Sittenburn Parish in Old Rappahannock County, Virginia, and in St. Anns Parish in Essex County, Virginia.  Among the neighbors of Robert Rutherford were Daniel Smith and John Miller, both of whom moved to Augusta County where they lived neighbors to the descendants of Robert Rutherford.

   A court order bearing the date August 4, 1684 show Robert Rutherford was appointed Constable by the Court of Old Rappahannock County, Virginia. Another court order dated March 3, 1686 ordered Robert Rutherford to pay tenancy on his plantation.  Among the wills witnessed by Robert Rutherford were those of Thomas Page of Old Rappahannock County, March 10, 1676; David Jameson of Essex County, December 2, 1711;  and Samuel Stallard of Essex County, December 2, 1720.

   Robert Rutherford was ordered by the Court of Essex County, Virginia to pay Robert Rutherford, Jr., and John Rutherford, Jr., for their attendance in court as witnesses on his behalf in August 1724.

Robert was captured at the battle of Homildon Hill in 1402, but was back in Scotland in 1405 when he received a pension on behalf of his mother. He was one of the hostages for the ransom of James I and was exchanged for the Earl of Menteith in 1427. In 1430 he was an ambassador to England and keeper of Dumbarton castle.

On the death of Alexander, Earl of Mar in 1435 Robert claimed the title in right of his mother and assumed the title of Mar and claimed one half of the lands of the earldom. On 22 Apr 1438 he was by means of a fraudulent plot served heir to the countess Isabel and in the following Nov. was given the estates. He was not however allowed to retain possession of it. In 1437 after the assassination of James I an act of Parliament was passed that no lands or possessions belonging to the King should be given to any man without consent of the three Estates until the young King James II should be 21 years old. At a General Council at Stirling 10 Aug. 1440 it was agreed: "for the good and quiet of the land, that the King should deliver up to Sir Robert Erskine, calling himself Earl of Mar, the castle of Kildrummie, to be kept by him till the King's majority when the said Sir Robert should come before the king and the three Estates, and show his rights and claims, as far as law will." At the same time Sir Robert delivered up to the King the castles of Mar and Dumbarton held by him. In 1442 Sir Robert took a protest at Stirling in the presence of the King and council complaining against the chancellor for refusing to return to him the Lordship of Garioch and put him in possession of the castle of Kildrummie. He afterwards beseiged and took the castle and the castle of Alloa which belonged to him was taken possession of in the King's name. In 1448 because of a new indenture Sir Robert was obliged to give the castle of Kildrummie to the King while Alloa was returned to Sir Robert. On 4 Apr. 1449 his son Thomas appeared before the King and Estates on behalf of his father. He offered to fulfil all previous agreements and protested against the fact that the revenues of the earldom had been detained by the King's officers. Another protest was submitted on 26 Jan. 1449/0 to the King and Parliament concerning the earldom of Mar which belonged to Robert by hereditary right and which was unjustly detained by the King.

On 18 Mar. 1390/91 Sir Thomas Erskine of Alloa and Dun appeared in person on the hill N. of St. Andrews monastery, where the King was sitting in full parliament, and stated that a certain contract had been made between Sir Malcolm of Drummond and Sir John of Swinton touching the lands of the earldorn of Mar and lordship of Garioch, of which earldom and lordship Isabel, the said Sir Malcolm's wife, is very and lawful heir-and, failing the heirs of her body, the half thereof pertains to my wife, of right of heritage. He obtained the (ineffectual) guarantee of the protection of these rights (Acts of Parl., vol. i, p.216(578); Hist. MSS. Corn., Mar and Kellie MSS., Supplement, p. ii). The (second) wife of Sir Thomas was Janet Keith, widow of Sir David Barclay, of Brechin, dau. and h. of Sir Edward Keith of Synton(s. of Sir Edward Keith, Marshal of Scotland, by Isabel de Synton his wife, by Christian his wife, sister and coh. of Sir John Menteith of Strathgartney, and dau. of Sir John Menteith of Arran by Ellen his wife, dau. of Gratney, Earl of Mar, abovenamed. This pedigree was proved in 1438 by Sir Robert Erskine, son of Sir Thomas and Janet, and 13th Earl of Mar, in his proceedings to be retoured heir of the Countess Isabel after the death of her second husband Alexander. He established the marriage of Sir John Menteith and Ellen by an infeftment, 5 Apr. 1359, from David II of the lands of Strathgartney to Sir John Menteith and Ellen, dau. of Gratney, Earl of Mar, his spouse; the two following generations were proved by oral evidence, and also by deeds, (i) a charter of Sir John Menteith, lord of Arran, in favour of Sir Edward Keith and his dau. Christian Menteith, and (ii) of the above said Thomas Erskine and Janet his spouse, with consent of their son Sir Robert abovenamed, to Duncan of Wemyss, son of Sir John Wemyss, and Elizabeth Erskine his spouse, their daughter, being settlements of the same lands (viz. the lands of Pirchock and Ludcairn) on the two marriages sutcessively (Douglas, Peerage of Scotland, 1764, p. 466 (1st nos.), quoting from Mar family papers; Mar Minutes of Evidence, 1868, p.88). In addition to the evidence of descent produced by Sir Robert in 1438, further confirmation is found in charters recorded by the above-quoted Mar and Kellie Supplement. (p.4) a charter of Sir John de Menteth, Lord of Arran (s. and h. of the abovesaid Sir John and Ellen of Mar), 21 May 1343, to Edward de Keith, Kt., the son, and Christian Bruce his spouse, sorori mee, of the same lands of Lodcarna and Perchok (the name Bruce here remains to be explained); and a charter (8 Sep. 1368) of Jean de Berclay, dau. and h. of Sir Edward de Keith, lord of Synton, with consent of her mother, Lady Christian de Keith, in the widowhood of the said Jean, of the lands of Michelstoun to Duncan Fleming and Christian his spouse. David II confirmed to Edward Keith lands given him by Edward Keith the Marshal (probably his mother's lordship of Synton-Reg. Mag. Sig., 1306-1424, p. 584). Christian de Keith, after the death of her husband Edward, married Sir Robert Erskine, father of the abovenamed Thomas, becoming thus as well his stepmother as his mother-in-law (Acts of Parl., vol. i, p. 164). Christian, wife of Sir Robert, d. 1387-88. In 1387 she drew the annuity which in 1388 had become payable to Sir Thomas Erskine. Her dau. Jane or Janet d. between Nov. 1412 and Whitsuntide 1413 (Exchequer Rolls, vol. iv, pp. 184, 260). That the Janet who m. Sir Thomas was the widow of Sir David Barclay is proved by the Soothfast witnesing of Thomas Bisset of Balwillo, 6 June 1437. He relates that, in his youth, he was servant to Sir Thomas Erskine, and often heard him and my lady Dam Jehan his wif, that was modir to David Steuart's modir, say,(Maule, Reg. de Panmure, vol. ii, p.230). This David Stewart was son of Walter (Stewart), Earl of Atholl, by Margaret, lady of Brechin, dau. of Sir David Barclay and Janet his wife. Sir Thomas Erskine, as mentioned above, claimed a right to the inheritance of half the Earldom for his wife. In 1435 the heirship to the other half was in the family of Lyle (Book of Pluscarden Hist. of Scotland, vol. ii, p.287; Lfe and Death of James I, Maitland Club, p.15)
